Terms of Service (TOS)
Acceptable Use Policy
IMPORTANT-READ CAREFULLY: BY PURCHASING SERVICES OR BY UTILIZING THE Gangus Internet Services, LLC SERVICES YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. THE Gangus Internet Services, LLC SERVICES ARE NOT AVAILABLE TO PERSONS UNDER 13 YEARS OF AGE. This is a legal agreement ("Agreement") between You and Gangus Internet Services, LLC ("GIS"), for use of the GIS services which You selected or initiated. "You" refers to the individual who registered and/or provided GIS his or her credit card or other payment mechanism for the Services or, if the Services are being purchased on behalf of an entity by an individual authorized to purchase the Services on behalf of such entity, then "You" refers to such entity. If You do not agree with the terms of this Agreement, do not use or join any meeting supported by, the Services. Any software associated with the Services is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.
GIS will provide the Services in accordance with this Agreement. GIS may at its sole discretion modify the features of the Services from time to time without prior notice.
The GIS Acceptable Use Policy is an effort to comply with all federal, state and local laws, as well as to protect the physical and logical security, and continuity, of the systems that GIS runs and the services that GIS offers. GIS customers agree not to store data on GIS computer systems that violates US law, the state laws of any state in which GIS does business in, or the local laws of any localities GIS does business in.
GIS customers also agree not to participate in, or aid others in, accessing any GIS computer system in a manner that it is not already being made accessible in, or accessing any customer data that is not their own.
Responsibility For Content
You agree that You are solely responsible for the content on your Web site or web presence made available by GIS. You agree that You will not use the Services to send unsolicited commercial e-mail outside Your company or organization in violation of applicable law. You further agree not to use the Services to communicate any message or material that is harassing, libelous, threatening, obscene, indecent, would violate the intellectual property rights of any party or is otherwise unlawful, that would give rise to civil liability, or that constitutes or encourages conduct that could constitute a criminal offense, under any applicable law or regulation. Although GIS is not responsible for any such communications, GIS may delete any such communications of which GIS becomes aware, at any time without notice to You.
Security
You must take reasonable security precautions in light of your use of our services. You must protect the confidentiality of your password(s), and you should change your password(s) periodically.
Charges
You agree that GIS may charge to Your credit card or other payment mechanism selected by You and approved by GIS ("Your Account") all amounts due and owing for the Services, including Service fees, set up fees, subscription fees, overage fees, conferencing fees, or any other fee or charge associated with Your use of the Services. You agree that in the event GIS is unable to collect the fees owed to GIS for the Services through Your Account, GIS may take any other steps it deems necessary to collect such fees from You and that You will be responsible for all costs and expenses incurred by GIS in connection with such collection activity, including collection fees, court costs and attorneys' fees. You agree that during this time, Your Services may be disabled or otherwise made inaccessible. You further agree that GIS may collect interest at the lesser of 2.0% per month or the highest amount permitted by law on any amounts not paid when due.
Proprietary Rights
GIS and/or its suppliers, as applicable, retain ownership of all proprietary rights in the Services and in all trade names, trademarks and service marks associated or displayed with the Services. You will not remove, deface or obscure any of GIS's or its suppliers' copyright or trademark notices and/or legends or other proprietary notices on, incorporated therein, or associated with the Services. You may not reverse engineer, reverse compile or otherwise reduce to human readable form any software associated with the Services.
Termination
You may terminate this Agreement by providing written notice to GIS via e-mail to support@gangusinternet.com. Such termination will be effective on the later of: (a) the last day of the term (if your Agreement has a fixed term), or (b) thirty (30) days after GIS's receipt of your written termination notice. If You fail to comply with any provision of this Agreement, GIS may terminate this Agreement immediately without notice. Sections 2 through 12, inclusive, shall survive any termination of this Agreement. Upon any termination of this Agreement, You must cease any further use of the Services and destroy any copies of associated software within Your possession and control. GIS reserves the right to terminate your service at any time for any reason without notice to you.
Export Restrictions
You acknowledge that the Services, or portion thereof may be subject to the export control laws of the United States. You will not export, re-export, divert, transfer or disclose any portion of the Services or any related technical information or materials, directly or indirectly, in violation of any applicable export law or regulation.
Lack of Guarantees
GIS provides the services listed above, and any other services provided in the future on a BEST EFFORTS BASIS. NO GUARANTEES ARE EXPRESSED OR IMPLIED related to data retention, integrity, continuance, or availability. Your data may become unavailable, or be destroyed by any number of events, not limited to fire, floods, acts of terrorism, or other man made or natural disasters.
Reservation of Rights
GIS reserves the right to revoke or alter this Terms of Service at any time. The company reserves the right to refuse service to any person organization for any reason, and reserves the right to terminate the service of any existing client for any reason.
